INTRODUCTION

The Constitution of Kenya, 2010, by declaring in Article 55(c) that the State “shall take measures […] to ensure that the youth […] access employment,” gave rise to the legitimate expectation that the State will assuage young Kenyans’ fear of unemployment after completing their education, leading to the enactment of The National Employment Authority Act, No. 3 of 2016 to actualise the wording and spirit of the Article 55 of the Constitution of Kenya, 2010; and yet youth unemployment , estimated at 35%, is 3½ times the national unemployment rate of 10%. Furthermore, 80% of unemployed Kenyans are below 35 years old. (Approximately 800,000 Kenyans enter the labour market every year.)

This case will address the failure of Parliament to implement Article 55(c) and its funnelling billions of taxpayers’ money to make a few richer while unemployed youth feel helpless and hopeless. This case involves the Constitution and Vision 2030, unemployed youth and educated youth consigned to work as semi-skilled workers. The Petitioners, Rayness Analytica Limited and Raymond Nduga, will be represented by Mr. Yuvenalis Kubwa of Kubwa & Co. Advocates against the National Employment Authority, The Cabinet Secretary for Labour and Social Protections and the Attorney General of Kenya.

Welcome and Good Day,

I trust this message finds you healthy and coping well. I am writing to you on behalf of our company, the First Petitioner, and myself, the Second Petitioner asking for your financial contribution to improve the lives of Kenyan youth. So, I am passing the hat to well wishers.

I am the Director of Rayness Analytica, LLC (www.raynessanalytica.com), a Nairobi-based team of professionals with an objective on focusing on law, projects, liaising with the government and businesses for the purpose of assisting foreign investors to open businesses in Kenya and hire Kenyan youth to bring down the unemployment rate. Unfortunately, the government has not provided a conducive environment for the Kenyan youth to access employment opportunities, obliging us to resort to litigation: “unemployment on trial”.

We have the brains, we have the information, we know the law, and we have the will power and public interest at heart to meet Government top lawyers in Court and challenge them for the sake of the future of these youth. The Government on the other hand has money and power.
